Union win! ACL cannot direct you to take annual leave

Last year, Australian Clinical Labs attempted to direct members to take their annual leave over the Christmas and New Year shutdown period, because they claimed they were a Medical Practice and not a Pathology Practice under the Award – a view that HSU members disputed.

Following a hearing earlier this month, yesterday the Fair Work Commission handed down their decision in favour of the Union. The Commission has determined ACL is in fact a Pathology Practice under the Award and cannot direct members to take their annual leave during a shutdown period.

This means you can use your leave as you want to.
