Are you regularly rostered to work your ordinary hours outside of 6am - 6pm, Monday to Friday?

Your Opal NSW enterprise agreement provides an additional week of annual for shiftworkers. For the purpose of assessing your entitlement, a shiftworker is an employee who is not a day worker (that is, someone who works between 6am - 6pm, Monday to Friday). The entitlement is pro-rata for part time employees.

So, if you’re not a Monday to Friday day worker, you may be entitled to additional annual leave. 

In March 2021, Opal Aged Care issued a memo to all staff announcing that they had changed what they consider to be a shift worker. This management decision meant that some staff had their entitlements cut and lost their additional annual leave!

HSU members have been fighting to ensure that everyone is paid what they’re entitled under your enterprise agreement – including additional annual leave for shiftworkers. Your additional annual leave is important compensation for working unsociable hours, such as afternoons, nights, and weekends.

HSU members have taken this issue to the Fair Work Commission, and we are calling on Opal to overturn their decision from last year which saw your entitlements cut.
