Are you entitled to additional annual leave? See below for more details!
HSU members who stood up against Opal’s changes to annual leave accrual, have won a landmark victory in the Fair Work Commission!
A Full Bench decision of the Fair Work Commission has confirmed the correct leave entitlements in the current Opal Aged Care (NSW) Enterprise Agreement 2016.
The decision found that an employee is a shiftworker if “their ordinary roster requires any part of their ordinary hours of work outside the day work span of hours” (which is 6am – 6pm Monday to Friday). A full copy of the decision can be found here.
What does this mean for you
Simply put, if you perform any work outside the hours of 6am – 6pm, Monday to Friday, you qualify as a shiftworker for that roster period.
That means that you should be accruing additional annual leave, up to 1 week per year. Your additional annual leave must be accrued each roster period, as you earn it.
Are you missing additional annual leave?
The HSU is concerned that many members have missed out on their additional annual leave. If you think that you might have missed out, please register your details with the HSU, so that we can request an audit of annual leave on your behalf.
If your colleagues are not yet HSU members, encourage them to join the union today so that we can pursue any missing annual leave on their behalf too. The union can only represent HSU members to recover your missing leave.
