In December 2020, CCLHD directed Wyong CSSD members to work from Gosford Hospital on a temporary basis for approximately 5-6 months. Under the Health Employees Conditions of Employment (State) Award 2019 Clause 13, staff would be paid excess travel fees and travel the extra time in work time.
This Monday 8 March, the HSU was in the Industrial Relations Commission again before Commissioner Murphy arguing to uphold the Award.
Our argument was that the Award provides for 'travel in work time' and that in the particular circumstances, the LHD had breached the Award and affected staff should be compensated at overtime rates.
The Ministry of Health argued that in the circumstances, the affected staff were entitled to nothing at all!
The Commissioner heard these arguments and has now 'reserved his decision' so he can consider the arguments and make his decision. We can't say for certain how long that will take.
