Your Rights at Work: Personal Leave Notice at WACF

Members at Windermere Aged Care Facility raised concerns around personal leave notice requirements because management had been giving staff different directives. The conflicting advice has placed unnecessary additional stress on staff needing to access their personal leave entitlement.

Your Organiser HyoJung Kim raised your concerns with management and they have responded in writing that “staff are requested to communicate with their direct manager, which may be the Facility Manager, Care Manager or RN in charge”. We can confirm that members no longer have to call any other manager after calling RN in charge.

In terms of timing of such notice, you are required to notify the employer “as soon as practicable” which, according to s 107 (1)(a) of the Fair Work Act, may be a time after the leave has started in an unforeseen circumstance.

Your management has acknowledged this and responded to us stating they “request staff to communicate with us prior to their shift, however we do understand that this is not always possible and provide staff sick leave if they are unwell.”
