Scalabrini Chipping Norton: Updated contracts

After months of extended discussions with Scalabrini Village Management on a dispute regarding some concerning terms in contracts proposed by Scalabrini in Feb/March this year, HSU members have been finally able to amend them.

Below are the Terms in the Clause 8.2 and 8.3 in the contracts that have been amended:

Clause 8.2

In the event you are unable to use the time and attendance biometric scanning system to confirm the commencement or conclusion times of your shift, you will be required to take a photograph of your full face without any mask or material being worn on the facial area. The clock at the designated biometric scanner is required to be displayed in the photograph. This image is to be sent by you via email to the Administration Manager for your respective Village, or a nominated member of staff as directed by Management of Scalabrini Village. Scalabrini will provide a device at each of its Villages with the means for you to comply with the instructions specified in this clause.

Clause 8.3

If you fail to adhere with the instructions specified in clauses 8.1 and 8.2, you will be given an opportunity to provide evidence verifying your time and attendance at work for any rostered shift in question by Scalabrini. Following review and consideration of the evidence (including, but not limited to, any evidence provided by you) Scalabrini will determine if any non-compliance with clauses 8.1 and/or 8.1 was reasonable under the circumstances. In the event Scalabrini can reasonably verify that you were not present at work for any period during your rostered shift, or if Scalabrini can verify that you wilfully did not comply with the instructions specified in clauses 8.1 and/or 8.2, Scalabrini will consider your absence to be unauthorised, resulting in unpaid leave. Non-compliance may also result in disciplinary action being taken against you.

If you haven’t signed the contracts yet, now you can sign them with the above amendments. Please note below are some important points that you need to know as discussed throughout this dispute:

  1. The above amended clauses 8.2 and 8.3 will replace those clauses under the old contracts and will be amended in the new contracts.
  2. Probation terms in your contract will not be applicable if you have worked for Scalabrini for more than 6 months.
  3. Your original employment date should be recognized in the calculation of any type of entitlements such as Long Service Leave, Redundancy pays, years of service etc.
  4. Scalabrini still requires you to take selfie photos and email that to your manager/nominated person from management while you are unable to clock in and out.
  5. Scalabrini will provide a device at each of its villages to take selfies.
  6. If you are unable to take selfies, you will be given an opportunity to provide other evidence verifying your time and attendance on your shifts
